People who have both Medicaid and Medicare  should never be charged for healthcare, medical or other services covered under Medicaid or Medicare. While this billing is prohibited by law, many providers often still bill the senior.  If you have been improperly billed, talk to the provider or seek help from an assistance organization.

Federal law, 42 U.S.C. § 1396a(n)(3)(B), provides that no Medicare-enrolled provider may require payment directly from a person covered by both Medicaid and Medicare.  The law imposes sanctions, including dis-enrollment from the Medicare program, for violating this provision.
